Terms of service
OVERVIEW
Welcome to Canada Reform Project! The terms “we,” “us,” and “our” refer to Canada Reform Project. Canada Reform Project operates this online store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Canada Reform Project is powered by Shopify, which enables us to provide the Services to you.
The following terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province, state, or jurisdiction of residence, or that you have given your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all activity associated with your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services. However, colours, sizing, positioning of designs, or product appearance may differ slightly from how they appear on your screen due to your device, display settings, manufacturing variations, or other factors.
We do not warrant that the appearance or quality of any products or services purchased by you will exactly match how they are depicted or rendered in our online store.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Canada Reform Project reserves the right to accept, decline, limit, or cancel an order for any lawful reason at our discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting it, as we may be unable to accommodate cancellation or modification requests after an order has been accepted or processed.
If we decline, modify, or cancel an order, we will attempt to notify you using the contact information provided with the order.
Purchases are subject to returns or exchanges solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for unauthorized commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect when the order is placed and will be set out in your order confirmation. Unless otherwise expressly stated, posted prices do not include applicable taxes, shipping, handling, customs duties, import charges, or other charges that may apply.
We may offer promotions that affect pricing and that are governed by terms separate from these Terms. If there is a conflict between the terms of a promotion and these Terms, the promotion-specific terms will govern.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases.
You represent and warrant that the payment information you provide is true, correct, and complete, that you are authorized to use the applicable payment method, and that you will pay all charges incurred at the posted prices, including applicable shipping charges and taxes.
SECTION 5 - SHIPPING AND DELIVERY
All delivery and processing times provided by Canada Reform Project are estimates only and are not guaranteed.
To the extent permitted by applicable law, we are not responsible for delays caused by shipping carriers, customs processing, weather, incorrect or incomplete shipping information provided by the customer, or other events outside our reasonable control.
Customers are responsible for providing a complete and accurate shipping address when placing an order. Additional costs resulting from an incorrect or incomplete address may be the responsibility of the customer to the extent permitted by applicable law.
Shipping, delivery, returns, and related matters may also be subject to our Shipping Policy and Refund Policy.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to trademarks, brands, names, logos, slogans, text, designs, displays, images, graphics, product photographs, videos, audio, and the design, selection, and arrangement thereof, are owned by Canada Reform Project, its affiliates, or its licensors, as applicable, and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services without our prior written consent, except as otherwise permitted by applicable law.
Nothing in these Terms grants you any license or other rights to the intellectual property of Canada Reform Project, Shopify, or any third party except as expressly provided.
The Canada Reform Project name, logos, product names, designs, and slogans may constitute trademarks or other intellectual property of Canada Reform Project or its licensors. You must not use them without prior written permission.
Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing through the Services are the property of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to tools offered by third parties as part of the Services that we neither monitor nor control.
You acknowledge and agree that access to such tools may be provided “as is” and “as available” without warranties, representations, or conditions of any kind, to the extent permitted by applicable law.
Any use by you of optional third-party tools is at your own risk and discretion, and you should ensure that you understand and agree to the terms of the relevant third-party provider.
We may offer new features, tools, or resources through the Services in the future. Such features will also be considered part of the Services and subject to these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and links to websites provided or operated by third parties, including social media platforms, payment providers, shipping providers, or other websites.
Our online store may also contain links to the main Canada Reform Project website or other Canada Reform Project pages that are separate from this Shopify-powered online store. Your use of those websites may be subject to separate terms, privacy policies, or other policies made available on those websites.
We are not responsible for examining or evaluating the content, accuracy, policies, security, or practices of third-party websites. If you leave the Services to access a third-party website, you do so at your own risk.
We are not liable for harm or damages arising from your access to third-party websites or your purchase or use of third-party products, services, resources, or content, to the extent permitted by applicable law.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Canada Reform Project is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Canada Reform Project. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Canada Reform Project, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Canada Reform Project.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify’s Privacy Policy.
Because the Services are hosted by Shopify, Shopify collects and processes certain personal information relating to your access to and use of the Services in order to provide and improve the Services. Information you submit through the Services may be transmitted to and shared with Shopify and other service providers, including providers located outside the country where you reside, as described in our Privacy Policy.
By using the Services, you acknowledge that you have had the opportunity to review the applicable privacy policies.
SECTION 11 - FEEDBACK
If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans, photographs, comments, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any lawful purpose, including commercial purposes, subject to applicable law.
You represent and warrant that you own or have the necessary rights to the Feedback you submit, that you have disclosed any compensation or incentives received in connection with it where required, and that your Feedback complies with these Terms.
We may, but are not obligated to, monitor, edit, or remove Feedback that we determine violates these Terms or applicable law.
You agree that your Feedback will not violate the rights of any third party, including copyright, trademark, privacy, personality, or other proprietary rights, and will not contain unlawful, abusive, obscene, malicious, or harmful content or software.
You are responsible for the Feedback you submit and its accuracy.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information provided through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, inventory, or availability.
We reserve the right to correct errors, inaccuracies, or omissions and to change or update information or cancel affected orders where permitted by applicable law.
SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only.
You may not use the Services to violate applicable laws or regulations; infringe upon intellectual property or other rights; harass, threaten, abuse, impersonate, defame, or unlawfully harm another person; knowingly transmit false or misleading information; distribute malicious software; engage in unauthorized spam or solicitation; collect personal information without authorization; interfere with the security or operation of the Services; circumvent security or access restrictions; or otherwise use the Services in a manner that is unlawful or that exposes Canada Reform Project, Shopify, our service providers, or users to liability.
You may not reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services except as expressly authorized by us or permitted by applicable law.
We reserve the right to suspend, disable, restrict, or terminate access to the Services where we reasonably determine that these Terms have been violated.
SECTION 14 - AGENTS AND AUTOMATED ACCESS
This section applies if you use, enable, or deploy automated software, artificial intelligence systems, agents, bots, scraping tools, or similar technology to access or interact with the Services.
Automated systems must not conceal their automated nature, circumvent CAPTCHAs or other access restrictions, interfere with the Services, bypass security measures, or access the Services in a manner we have expressly prohibited.
We may use technical measures to limit or prevent automated access to the Services.
SECTION 15 - TERMINATION
We may terminate or restrict your access to the Services, or any portion thereof, where permitted by applicable law, including where we reasonably determine that you have violated these Terms.
You remain responsible for amounts properly due up to and including the date of termination.
Any provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, feedback, disclaimers, limitations of liability, indemnification, severability, governing law, and privacy.
SECTION 16 - DISCLAIMER OF WARRANTIES
The information presented on or through the Services is provided for general informational purposes. While we endeavour to provide accurate information, we do not warrant that all information will always be complete, accurate, current, or suitable for every purpose.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT AS EXPRESSLY STATED BY CANADA REFORM PROJECT OR REQUIRED BY LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES, CONDITIONS, RIGHTS, OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
SECTION 17 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CANADA REFORM PROJECT AND ITS AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SECTION 18 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Canada Reform Project, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party losses, damages, liabilities, claims, and reasonable legal fees arising from your material breach of these Terms, violation of applicable law or the rights of a third party, or unlawful misuse of the Services.
We will provide reasonable notice of an indemnifiable claim where practicable. We may participate in or control the defence of such a claim as permitted by applicable law, and you agree to reasonably cooperate in the defence.
SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or severed to the minimum extent necessary. The remaining provisions will continue in full force and effect.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
These Terms, together with the policies and operating rules posted through the Services, constitute the agreement between you and us regarding your use of the Services and supersede prior agreements or communications relating to the same subject matter, except where otherwise required by applicable law.
SECTION 21 - ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.
We may transfer or assign these Terms and our rights and obligations as permitted by applicable law.
SECTION 22 - GOVERNING LAW
These Terms and any separate agreements through which we provide the Services will be governed by and construed in accordance with the laws applicable to Canada Reform Project and the applicable federal laws of Canada, without limiting any mandatory consumer protections or rights that may apply to you under the laws of your jurisdiction.
